Terms of Service

These Terms of Service (“Terms”) govern your access to and use of BeamRatings (“BeamRatings,” “we,” “us”), a service that helps local businesses request and manage customer reviews. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The service

BeamRatings lets you send review-request emails to your own customers, collect ratings and private feedback, and optionally list your business in our public directory. We may add, change, or remove features over time.

2. Your account

You are responsible for your account, keeping your password secure, and all activity under your account. You must provide accurate information and be at least 18 years old and able to form a binding contract.

3. Your customers' data and consent

You may only upload and email contacts who are your genuine customers and who you have a lawful basis to contact. You represent that you have obtained any consent required by law to send them review requests. You are the controller of your customers' personal data; BeamRatings processes it on your behalf to provide the service. You are responsible for complying with all applicable laws, including anti-spam laws (such as CAN-SPAM), Google's review policies, and FTC rules. Do not use the service to send unsolicited bulk email or to incentivize, gate, or fake reviews.

4. Acceptable use

Do not misuse the service: no unlawful, deceptive, harassing, or infringing activity; no attempts to breach security, scrape, overload, or reverse-engineer the service; and no sending of content you are not authorized to send. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, billing & cancellation

Paid plans are billed in advance on a recurring basis through our payment provider until you cancel. Prices are shown at sign-up and may change with notice for future billing periods. You can cancel anytime from the Billing page; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and we do not provide prorated refunds for partial periods. Free trials convert to a paid plan only if you choose one; otherwise sending pauses when the trial ends.

6. Reviews are never suppressed

BeamRatings shows every customer the option to post a public review regardless of their rating, and never posts fake reviews. You agree not to use the service in any way that would violate Google's policies or the FTC's rules on endorsements and reviews.

7. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will produce any particular number of reviews or business results.

8. Limitation of liability

To the fullest extent permitted by law, BeamRatings will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim.

9. Indemnification

You agree to indemnify and hold BeamRatings harmless from claims arising out of your use of the service, your content, your customers' data, or your violation of these Terms or of any law, including anti-spam and review-related laws.

10. Termination

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms or to comply with law. On termination, your right to use the service ends; you may request deletion of your data as described in our Privacy Policy.

11. Changes & governing law

We may update these Terms from time to time; material changes will be reflected by the “Last updated” date, and continued use means you accept them. These Terms are governed by the laws of the state in which BeamRatings is established, without regard to conflict-of-laws rules.
